These Terms of Use govern your access to and use of the Kramer Golf website, applications, fantasy golf features, tournament tools, scoring tools, media content, and related services collectively referred to as the “Services.”

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

For purposes of these Terms, “Kramer Golf,” “we,” “us,” and “our” refer to Kramer Golf Media, LLC.

1. Use of the Services

Kramer Golf provides golf-related content, fantasy golf tools, league-management features, tournament-management features, scoring tools, leaderboards, and related services.

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Services for illegal activity
• Interfere with or disrupt the Services
• Attempt to gain unauthorized access to any system, account, or data
• Scrape, copy, or harvest data except as expressly permitted
• Upload malicious code or harmful content
• Impersonate another person or misrepresent your identity
• Abuse, harass, threaten, or harm other users
• Use the Services in a way that violates applicable laws, regulations, or third-party rights

2. Eligibility

You must be at least 13 years old to use the Services.

If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian.

By using the Services, you represent that you meet these eligibility requirements.

3. Accounts

Some features may require an account. You agree to provide accurate information and keep your account information current.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us promptly if you believe your account has been compromised.

We may suspend or terminate your account if we believe you have violated these Terms, created risk for Kramer Golf or other users, or used the Services improperly.

4. Fantasy Golf, Leagues, and Tournament Tools

Kramer Golf may allow users to create or participate in fantasy golf leagues, golf pools, scoring competitions, tournament events, Ryder Cup-style formats, team competitions, leaderboards, and related activities.

Unless expressly stated otherwise, these features are intended for entertainment, informational, and organizational purposes only.

You are responsible for the rules, administration, eligibility, scoring decisions, prizes, and disputes associated with any private league, group, tournament, or event you create or join.

Kramer Golf may provide tools to help organize or display information, but we are not responsible for resolving disputes between users, league commissioners, tournament organizers, players, or participants.

5. No Gambling or Wagering

The Services are not a sportsbook, casino, gambling platform, betting exchange, or real-money wagering service.

You may not use the Services to conduct, process, collect, manage, advertise, or settle illegal bets, wagers, gambling pools, or games of chance.

If your league, tournament, or event includes prizes, entry fees, side games, or other financial arrangements, you are solely responsible for ensuring that those arrangements comply with all applicable laws and regulations.

Kramer Golf does not provide legal advice about fantasy sports, contests, prizes, sweepstakes, gambling, or wagering laws.

6. Scoring and Data Accuracy

Kramer Golf may display golf scores, player data, leaderboards, tournament data, fantasy standings, or other information from user submissions, public sources, third-party providers, or automated data feeds.

We try to provide useful and accurate information, but we do not guarantee that any data, score, statistic, tee time, leaderboard, tournament status, player status, or result will be accurate, complete, current, or error-free.

Scores and results may be delayed, incomplete, corrected, or changed. You are responsible for verifying information before relying on it.

7. Content and Media

The Services may include articles, previews, recaps, commentary, rankings, fantasy analysis, opinions, images, videos, graphics, or other media.

Content is provided for informational and entertainment purposes only. It should not be considered professional advice, betting advice, financial advice, or a guarantee of performance or results.

We may update, remove, modify, or discontinue content at any time.

8. User Content

You may be able to submit, upload, create, or share content through the Services, including league names, team names, comments, scoring information, tournament details, player information, images, or other materials “User Content.”

You retain ownership of your User Content, but you grant Kramer Golf a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, modify, publish, and distribute your User Content as needed to operate, improve, promote, and provide the Services.

You represent that you have the rights necessary to submit your User Content and that your User Content does not violate any law, third-party right, or these Terms.

We may remove or restrict User Content at any time if we believe it violates these Terms or creates risk for Kramer Golf or others.

9. Intellectual Property

The Services, including the Kramer Golf name, logos, designs, software, features, graphics, text, layouts, and other materials, are owned by Kramer Golf or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services unless expressly permitted by us in writing.

All third-party names, logos, tournaments, leagues, player names, and trademarks belong to their respective owners. Use of third-party names or data does not imply affiliation, endorsement, or sponsorship unless expressly stated.

10. Third-Party Services and Links

The Services may contain links to third-party websites, applications, services, data sources, payment processors, authentication providers, or content.

We do not control and are not responsible for third-party services. Your use of third-party services is subject to their own terms and privacy policies.

11. Paid Features

Kramer Golf may offer paid features, subscriptions, entry tools, premium content, or other paid services.

If paid features are offered, pricing, billing terms, renewal terms, cancellation rights, and refund policies will be provided at the time of purchase or in supplemental terms.

Unless otherwise stated, fees are non-refundable except where required by law.

12. Promotions, Sponsors, and Affiliate Content

Kramer Golf may include sponsored content, affiliate links, promotional offers, or advertising relationships.

We may receive compensation when users click links, make purchases, or interact with certain offers. Sponsored or affiliate relationships will be disclosed where required.

13. Availability and Changes to the Services

We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We are not responsible for outages, data loss, delays, scoring issues, or disruptions caused by third-party providers, internet problems, hosting issues, maintenance, or events outside our control.

14. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Kramer Golf disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

We do not guarantee that the Services will meet your expectations, produce any particular result, or be free from errors, defects, interruptions, or security vulnerabilities.

15. Limitation of Liability

To the fullest extent permitted by law, Kramer Golf and its owners, officers, employees, contractors, partners, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, service interruption, or other intangible losses.

To the fullest extent permitted by law, Kramer Golf’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:

• The amount you paid to Kramer Golf for the Services in the 12 months before the claim arose; or
• $100

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Kramer Golf and its owners, officers, employees, contractors, partners, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any law or third-party right
• Any league, tournament, contest, prize, wager, or event you create, administer, or participate in

17. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms, created risk, caused harm, or used the Services improperly.

You may stop using the Services at any time.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.

18. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

You agree that any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Fulton County, Georgia, unless applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you by posting the updated Terms on the Services, updating the “Last updated” date, or providing additional notice as appropriate.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
